The Public Health and Wellbeing Regulations 2019 (the regulations) provide registration requirements, general duties of aquatic facility operators and the minimum requirements for aquatic facilities, including:

  • water quality standards
  • record-keeping
  • response procedures for non-compliant water quality
  • requirements for aquatic facilities suspected or implicated as a source of infection.

The Victorian Government has introduced new requirements for aquatic facilities to minimise illness transmission from aquatic facilities by providing an efficient and effective response framework for aquatic facilities and local councils.

Preventing and minimising illness associated with aquatic facilities reduces:

  • the burden of disease associated with aquatic facilities
  • the economic impact of illness from loss of productivity
  • business closure and reputational impacts associated with outbreaks.

The regulations have been broadened to include new types of aquatic facility that may pose a risk to public health. They include risk-based classification of aquatic facilities as Category 1 and Category 2.

Category 1 and 2 aquatic facility operators are required to comply with the regulations, including managing health risks associated with water quality. The Department of Health has developed support materials to assist aquatic facility operators.

Category 1 aquatic facilities

A Category 1 aquatic facility means a swimming pool, spa pool or interactive water feature that is:  

  • used by members of the public, whether free of charge or on payment of a fee
  • used in association with a class or program that is offered free of charge or on payment of a fee
  • located at the premises of an early childhood service, school or other educational institution
  • located at premises at which residential aged care services are provided 
  • located at a public hospital
  • located at a multipurpose service
  • located at a denominational hospital
  • located at a private hospital
  • located at a privately-operated hospital within the meaning of section 3(1) of the Health Services Act 1988.

Category 2 aquatic facilities

A Category 2 aquatic facility means a swimming pool or spa pool that is used by members of the public and is located at the following premises:

  • a residential apartment complex
  • a hotel, motel or hostel.

Register your aquatic facility

If you operate a Category 1 aquatic facility in Boroondara, you need to register it with us. Pool operators are responsible for registering the facility and managing public health risks.
