What we are proposing to discontinue and sell
Council is proposing to discontinue and sell the 3.05 m wide road reserve at the front of 41 McShane Street in Balwyn North, which is shown hatched on the plan below (the Road).
Council is proposing to sell the land from the Road to the owner of 41 McShane Street, Balwyn North, by private treaty in accordance with Council’s Discontinuance of Roads and Reserves Policy.
Conditions of sale
The purchaser must reimburse Council its costs associated with the discontinuance and sale of the Road estimated to be $16,925.00 (inclusive of GST).
The title of the land must be consolidated with the title for the purchaser’s main property within 12 months of the completion of the sale of the land.

Council is inviting submissions on this proposal to discontinue and sell the Road. You can make a submission before 5 pm Friday 31 May 2024.

- provide your submission in person at the Council offices, 8 Inglesby Road, Camberwell.

You can also ask to appear at a Council or committee meeting in person or have someone represent you. Council will notify you of the date, time and place of the meeting once it is determined.
How we manage submissions and make our decision
We manage all submissions and personal information in line with the Privacy and Data Protection Act 2014.
We will consider all submissions in line with section 223 of the Local Government Act 1989.
After we have considered the submissions, we may decide to discontinue and sell the Road, part of the Road, or not to discontinue and sell the Road.
This notice is in line with section 114 of the Local Government Act 2020 and Council’s Community Engagement Policy.
