What we are proposing to discontinue and sell

Council is proposing to discontinue and sell the road adjoining 259 and 267 Whitehorse Road and 1A Weston Street, Balwyn, which is shown hatched on the plan below (the Road).

Council is proposing to sell the land from the Road by private treaty to the adjoining owner of 259 to 281 Whitehorse Road and 1A Weston Street, Balwyn, at full market value for $1,320,000.00 inclusive of GST. This is in line with Council’s Discontinuance of Roads and Reserves Policy.

Conditions of sale

The Purchaser:

  • must pay Council’s costs related to the discontinuance and sale of the Road estimated at $57,000.00.
  • consolidate the title of the land with the title for its adjoining properties within 12 months of the completion of the sale of the land.
  • enter into a Contract of Sale for the acquisition of the land, if the discontinuance is successful.
  • give an undertaking to Council not to allow the existing buildings on its land at 259 and 267 Whitehorse Road and 1A Weston Street, Balwyn, to be occupied, while those buildings are, and remain, on the land until such time as they have been demolished.

Council is inviting submissions on this proposal to discontinue and sell the Road. You can make a submission before Monday 25 March 2024.

You can also ask to appear at a Council or committee meeting in person or have someone represent you. Council will notify you of the date, time and place of the meeting once it is determined.

How we manage submissions and make our decision

We manage all submissions and personal information in line with the Privacy and Data Protection Act 2014.

We will consider all submissions in line with section 223 of the Local Government Act 1989. 

After we have considered the submissions, we may decide to discontinue and sell the Road, part of the Road, or not to discontinue and sell the Road.

This notice is in line with section 114 of the Local Government Act 2020 and Council’s Community Engagement Policy.
